Due to pandemic situations MCA has given the various relaxation in the provision of Companies Act 2013 for ease of doing business and same announcement is made by our Hon’ble Finance Minister Ms. Nirmala Sitharaman by their Twitter handle

1. Extension of Companies Fresh Start Scheme

The Ministry of Corporate Affairs vide circular No. 12/2020 dated 30.03.2020 had introduced a new scheme known as the Companies Fresh Start Scheme, 2020, valid from 01.04.2020 to 30.09.2020 to enable companies to make good their previous defaults. This Scheme has now been extended till 31.12.2020.

2. Extension of LLP Settlement Scheme

he MCA had also introduced a new scheme known as the LLP Settlement Scheme, 2020 vide circular No. 13/2020 dated 30.03.2020 which was valid from 01.04.2020 to 13.06.2020. The Scheme has been further extended to 31.12.2020 to enable LLPs to make good their previous defaults.

3. Extension of Time-Scheme for relaxation of time for filing forms related to creation or modification of Charges under the Companies Act 2013

The Scheme for relaxation of time for filing forms related to creation or modification of charges under the Companies Act, 2013  also stand extended till 31.12.2020.

4. Extension of Time- Conducting of EGM through Video Conferencing or Other Audio Visual Means

Ministry of Corporate Affairs has decided to allow companies to conduct their EGMs through VC or OAVM or transact items through postal ballot upto 31st March 2020

5.  Extension of Time – To register the names of Independent Directors  on the Databank maintained by IICA

The Minsitry of Corporate Affairs has also extended the time within which Independent Directors of Company have to register themselves on the Databank maintained by IICA from 30.09.2020 to 31st December 2020.
