HIGH COURT ORDERS OPENING OF TRAN-1 PORTAL BY JUNE 19, 2020

Vide its order dated May 05, 2020, in the case of M/s Brand Equity Treaties Limited, Hon’ble Delhi HC held that time limit provided in Rule 117 is directory, and not mandatory.

It was also ordered by the Hon’ble HC to publicize the order in general and allow all assessees including petitioners, entitled to file TRAN-1, to file the same.

Now, in the case of M/s Mangla Hoist Private Limited v. Union of India & Ors, it has again been held by the Hon’ble Delhi HC, vide its order dated June 17, 2020, that the judgment in the case of Brand Equity Treaties has not been stayed so far, and therefore Department is under an obligation to abide by the directions issued therein.

Directions have been issued to the Department to ensure compliance of captioned judgment latest by June 19, 2020 which will leave only 10 clear days for eligible assessees including petitioners to take necessary steps.

Similar relief has been given to taxpayers by the Hon’ble Delhi HC in the case of M/S SKH Sheet Metals Components v. Union of India & Ors., vide its order dated June 16, 2020.
